Terms of Service

Welcome to FrostySpot. These Terms of Service ("Terms") govern your use of the FrostySpot platform, website, and mobile application (collectively, the "Service") operated by FrostySpot ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

FrostySpot is a hyper-local ordering platform that connects customers with ice cream truck operators in their area. The Service allows customers to browse nearby trucks, place orders, and arrange delivery to a confirmed GPS location. FrostySpot is a technology platform and is not itself an ice cream vendor.

2. Eligibility

You must be at least 13 years of age to create an account. By using the Service, you represent that you meet this requirement. Users under 18 should have parental or guardian consent before using the Service.

3. Accounts

You may create an account using email and password or through a supported third-party provider (such as Google). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at hello@frostyspot.com if you suspect unauthorized access.

4. Orders and Payments

• Orders placed through FrostySpot are subject to acceptance by the truck operator. Operators may decline orders at their discretion.
• Pricing is set by the truck operator and displayed before checkout. FrostySpot does not add delivery fees or taxes at this time; the total shown at checkout is the total you pay.
• Optional tips may be added at checkout. Tips go directly to the operator and their runners.
• Once an order is placed and accepted, cancellations are at the operator's discretion. If an order is not fulfilled, you are entitled to a full refund.
• Payment processing is handled by third-party providers. FrostySpot does not store your payment card information.

5. Delivery and Location

FrostySpot requires access to your device's GPS to confirm your delivery spot. You are responsible for ensuring your confirmed location is accurate and accessible. Delivery is performed by the truck operator or their assigned runner. Estimated arrival times shown in the app are approximate only.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation in Ontario or Canada;
• Submit false, misleading, or fraudulent orders;
• Interfere with or disrupt the Service, its servers, or networks;
• Attempt to gain unauthorized access to any portion of the Service;
• Use automated means (bots, scrapers, etc.) to access the Service without our written permission;
• Harass, threaten, or harm operators, runners, or other users.

7. Intellectual Property

All content, branding, logos, and software comprising the FrostySpot Service are the property of FrostySpot or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent. Menu content uploaded by operators remains the property of the respective operator.

8. Push Notifications and Communications

If you opt in to push notifications, we may send you order status updates, promotional offers, and service announcements. You can withdraw consent at any time through your device notification settings or your account profile. If you opt in to email marketing at sign-up, we may send you promotional emails. You can unsubscribe at any time using the link in any email or by updating your profile.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. FrostySpot does not guarantee uninterrupted or error-free operation of the Service.

FrostySpot is not responsible for the quality, safety, legality, or availability of products sold by truck operators. Any concerns about a specific product should be directed to the operator.

10. Limitation of Liability

To the maximum extent permitted by Ontario law, FrostySpot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service. Our total cumulative liability to you shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold FrostySpot, its officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
